Agreement to Terms

By accessing or using SummonGhost ("Service"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the Service.

Description of Service

SummonGhost is a platform that allows users to create AI-powered digital representatives ("ghosts") that can interact with visitors on their behalf. The Service includes:

  • Creating and customizing AI ghosts
  • Training ghosts with documents and character descriptions
  • Enabling visitors to chat with your ghost
  • Optional integrations with third-party services (Google Calendar, Gmail, Google Drive, Dropbox)

Account Registration

To use certain features, you must register for an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use

User Content

You retain ownership of content you create ("User Content"), including ghost configurations, documents, and conversation data. By using the Service, you grant us a license to:

  • Store and process your content to provide the Service
  • Display your ghost's public profile to visitors
  • Use aggregated, anonymized data to improve the Service

Content Guidelines

You agree not to create or configure ghosts that:

  • Impersonate others without authorization
  • Promote illegal activities or violence
  • Contain hate speech or harassment
  • Distribute malware or spam
  • Violate intellectual property rights
  • Deceive users about the AI nature of the ghost

Connected Services

The Service allows you to connect third-party accounts (Google, Dropbox) to enhance your ghost's capabilities. By connecting these services:

  • You authorize us to access the specified data on your behalf
  • You understand that only you (the ghost owner) can access this data through your ghost
  • You can disconnect services at any time
  • You remain subject to the terms of service of those third-party providers

AI-Generated Content

Ghost responses are generated by AI and may not always be accurate, complete, or appropriate. You acknowledge that:

  • AI responses do not constitute professional advice
  • You are responsible for reviewing content your ghost produces
  • We are not liable for actions taken based on AI-generated content
  • Ghosts should not be used for decisions requiring professional expertise (medical, legal, financial)

Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service or servers
  • Scrape, crawl, or spider any content without permission
  • Use automated systems to access the Service in a manner that exceeds reasonable use
  • Resell or redistribute the Service without authorization

Intellectual Property

The Service, including its original content, features, and functionality, is owned by SummonGhost and is protected by international copyright, trademark, and other intellectual property laws.

Termination

We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

You may terminate your account at any time by contacting us. Upon termination, your right to use the Service will immediately cease.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

We do not warrant that:

  • The Service will function uninterrupted or error-free
  • Errors or defects will be corrected
  • The Service is free of viruses or harmful components
  • AI-generated content will be accurate or appropriate

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SUMMONGHOST, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to or use of (or inability to access or use) the Service
  • Any conduct or content of any third party on the Service
  • Any content obtained from the Service
  • Unauthorized access, use, or alteration of your transmissions or content

Indemnification

You agree to defend, indemnify, and hold harmless SummonGhost and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of the Service or violation of these Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which SummonGhost operates, without regard to its conflict of law provisions.

Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
