Agreement
These terms are an agreement between you and SummonGhost, Inc., a Delaware corporation ("SummonGhost", "we"), for summonghost.com and the SummonGhost hosted desktop service. By creating an account or using the service, you agree to them. If you use it for an organization, you agree for that organization.
The service
SummonGhost runs a cloud computer for you, reachable from your browser, with Ghost, an AI agent that can work on it at your direction. Features, plans and the AI models Ghost uses may change as the service develops.
Your account
You must be able to form a binding contract to use the service. Keep your sign-in account secure; you are responsible for activity under your account.
Subscriptions and billing
- During the invite-only period, desktops are free. We will give notice before charging, and nothing is billed without your subscribing.
- Desktops are billed monthly in advance at the price shown when you subscribe, plus any applicable taxes, through our payment processor, Stripe.
- Subscriptions renew automatically each month until cancelled. You can cancel at any time from your account; your desktop stays available until the end of the period you have paid for.
- Payments are non-refundable, except where the law requires otherwise.
- We will tell you before a price change applies to your subscription, and it takes effect from your next renewal after the notice.
- If a payment fails or your subscription ends, we suspend your desktop. If it is not resumed within 30 days, we delete it and its files.
Your content
You own what you put on your desktop and in your conversations. You give us permission to store and process it only as needed to provide the service to you. Keep your own copies of anything important: we do not promise that desktop data can be recovered after loss or deletion.
Ghost and AI output
Ghost acts on your desktop at your direction, including running commands, changing files and using the apps and services you connect. You are responsible for what you ask it to do and for actions it takes on your behalf. AI output can be wrong; review it before relying on it. Ghost is not a substitute for medical, legal, financial or other professional advice.
Acceptable use
You may not use the service to:
- break the law or violate another person's rights;
- gain unauthorized access to accounts, systems, or data;
- send spam, run malware, mine cryptocurrency, or attack other systems;
- disrupt, overload, scrape, or probe the service without permission.
We may suspend or end access to stop abuse, protect users or the service, or comply with law. Where we reasonably can, we will tell you first.
Ghost, the open-source app
Ghost for your own computer is open-source software under the Apache License 2.0. That license, not these terms, governs your use of it.
No warranty
To the maximum extent allowed by law, the service is provided "as is" and "as available," without warranties of any kind, including fitness for a particular purpose and uninterrupted or error-free operation.
Liability
To the maximum extent allowed by law, SummonGhost is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, goodwill, or use. Our total liability for any claim about the service is limited to the amount you paid us in the 12 months before the claim. Nothing here excludes liability that cannot legally be excluded.
Ending the agreement
You can stop using the service and ask us to delete your account at any time. We may end these terms if you materially breach them. Sections that by their nature should survive, such as payment obligations, warranty disclaimers and liability limits, survive.
Governing law
These terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. Nothing here takes away rights that the law of your country of residence gives you as a consumer and that cannot be waived.
Changes
We may update these terms. We will tell account holders by email about material changes before they take effect. The date above shows the latest version. If one provision is unenforceable, the rest continue to apply.
